RATE OF INTEREST - TO BE DETERMINED ACCORDING TO ARTICLE 7.4.9 UNIDROIT PRINCIPLES IRRESPECTIVE OF SOLUTION ADOPTED BY THE LEX CONTRACTUS SINCE UNIDROIT PRINCIPLES PERMIT ADOPTION OF "A JUST AND REASONABLE" RATE OF INTEREST

Abstract

In a dispute the Arbitral Tribunal applied Article 7.4.9 of the UNIDROIT Principles irrespective of the solution adopted by the lex contractus or any other domestic laws applicable according to the relevant conflict of laws rules on the ground that the UNIDROIT Principles permit the application of "a just and reasonable" rate of interest.
