Abstract

A Dutch seller and a German buyer concluded in 1986 a contract for the sale of four pieces of equipment. A dispute arose between the parties.

The Court, without mentioning Art. 100 CISG, found that CISG was not applicable since the contract had been concluded before 1991, the date of entry into force of CISG in Germany.

Der Anwendbarkeit des EKG steht nicht entgegen, daß es mittlerweile mit wirkung v. 1.1.1991 durch das UNCITRAL- Abkommen abgelöst worden ist. Denn das EKG gilt gem. Art. 5 Abs. 2 des Gesetzes zur Ratifizierung des UNCITRAL-Abkommens (5.7.1989) für solche Verträge fort, die vor dem 1.1.1991 geschlossen worden sind.
