A Belgian buyer bought clothing from a German seller. The seller sued the buyer for payment of the price.
The Court found that CISG was applicable. I held that according to Arts. 61 and 63 CISG, it was not up to the Court to grant a period of grace to the buyer; such a right could only be excercised by the seller. The Court ordered the buyer to pay the price plus interest. |
