| An Italian company and a Dutch company concluded an oral agreement whereby the Dutch company was to sell in Europe, except in France and Italy, shower cabinets produced by the Italian company.
The court held that CISG was not applicable as the agreement was not a contract of sale but a distribution agreement. The court noted, however, that CISG would have been applicable to each separate contract of sale concluded under the distribution agreement. |
