In a case involving the avoidance of a domestic lease contract made by telefax, the Austrian Supreme Court had to decide whether a telefax fulfills the writing requirement prescribed by the applicable Austrian law.

The argument was made that, in accordance with the principles laid down in Art. 13 CISG, a message sent by telefax should be considered valid.

The Supreme Court observed that Art. 13 CISG is applicable only to international sales contracts and therefore rejected the application of CISG by analogy to lease contracts.
